This Privacy Policy describes how Yogi Bins, Inc. collects, protects, uses, retains, and discloses your personal information when you visit our website, purchase products, or otherwise interact with us through our websites from which you are accessing this Policy, our social media pages on third-party social media platforms, email, text, mail, and any offline business interactions you have with us (collectively, the “Services”). It also explains your privacy choices and rights, as well as how to exercise them. 

For purposes of this Privacy Policy, “you” (and its formatives) means any visitor, customer, or individual whose information is collected through the Services. A reference to “Yogi Bins,” “we,” “us,” or “our” is a reference to Yogi Bins, Inc.

By accessing or using our Services, you signify your acceptance of this Privacy Policy and consent to the collection, use, and disclosure of your personal information as described below. If you do not agree with this Privacy Policy, please do not access or use the Services.

1.  When These Privacy Principles and Practices Apply

This Privacy Policy applies to any access or use of the Services. In addition, your access to and use of the Services is governed by separate terms, including without limitation Terms of Use.

The Services are not intended for children and we do not knowingly collect data relating to children.

 1.1 Personal Information

You may be asked to provide and/or Yogi Bins may collect your personal information anytime you are in contact with Yogi Bins. Personal information is information that can be used to identify or contact a natural person or household. Yogi Bins may share this personal information and use it consistent with this Privacy Policy. We may also combine it with other information to provide and improve our Services, content, and advertising. You are not required to provide the personal information we request, but, if you choose not to do so, in many cases we will not be able to respond to any queries you may have or you may not be able to utilize all functionality of the Services. 

If you do not agree with the data practices described in this Privacy Policy, you should not use or access Yogi Bin’s Services.

1.2  Third Party Links and Social Media Features

Our Services may contain links to other websites maintained by third parties, social media features which are either hosted by a third party or directly on our website, and/or mini-programs that run on our website. Third party websites and features may collect your personal information, such as your internet protocol (“IP”) address, which page you are visiting on our website, and may set a cookie to enable the feature to function properly. 

Primarily, third party websites accessible through links in the Services are governed by their own privacy policies. Yogi Bins does not control, and is not responsible for, the content or practices of these other websites. Our provision of a link does not constitute our endorsement of these other websites, their content, their owners, or their practices and this Privacy Policy does not apply to these other websites, which are subject to any privacy or other policies they may have.  We encourage you to be aware when you leave our website and to read the privacy statements of any other site that collects personal information.

This Privacy Policy also does not apply to social media features or mini-programs either hosted by a third party or directly on our website; instead, your interactions with such features, widgets, and/or mini-programs are governed by the privacy statements and policies of the companies providing them.

2.  Information We Collect

The categories of personal information we collect and have collected, including in the preceding 12 months, are as follows (note that not all categories may be collected about every individual):

  • Identifiers such as your name, customer number, and unique personal identifier or similar identifier

  • Contact Information such as phone number, mailing and billing addresses, and email address

  • Demographic Data such as age range, gender, and estimated income

  • Commercial or Transaction Data such as engagement with our websites, the number of times you have visited our Services, order details, amount charged, products considered, purchased, returned, or exchanged, and payment method

  • Device and Network Data such as IP address, login data, browser type and version, browser plug-in types and versions, operating system and platform used, device settings, unique device identifiers, logs, and other technology on devices you use to access our websites

  • Internet Activity Data such as your interactions with our website and what led you to our website.

  • Behavioral and Preference Data such as preferences, tendencies, or interests based on orders made by you, items viewed, feedback or survey responses, and other preference data

  • Usage Data such as information about how you use our Services like date and time of your visit to our websites, clicks, browsing history, and website traffic data

  • Account Data such as information to activate and maintain your Yogi Bins account, such as account number, account creation date, and last login date

  • Marketing and Communications Data such as your preferences in receiving email, text or other marketing from us, participate in sweepstakes and other prize competitions, and other communication preferences

  • User Content you choose to create, submit or share with us or others in connection with our Services (for example, product reviews, feedback, social media posts, or other contributions). Depending on where it is shared, this content may be visible to other users or to the public 

  • Inferences drawn from or created based on any of the above information categories, including information about your interests, preferences, and favorites.

  • Sensitive personal information in limited circumstances and described further below

The list provided above also includes Personal Information Categories Listed in the California Customer Records Statute (e.g., name, address, telephone number, personal characteristics or description, employment; some of this information may overlap with other categories) as defined under the CCPA.

2.1 Information You Provide Us

We collect information that you voluntarily provide when interacting with us in various ways, including registering for an account, placing an order, responding to surveys or focus groups, applying for a job, or otherwise completing forms. For example:

  • Product and service inquiries: If you request additional information about our products, contact us through our website or by social media, register for an account, or participate in an online survey, we may collect your name, mailing address, job title, company name, phone number, email address, demographic information, contact preferences, profile information (when contact is made via social media) and billing details.

  • Feedback and requests: If you voluntarily submit information (for example, responding to a survey about your user experience), we collect the information you provide as part of that request

  • Employment applications: If you apply for a job at Yogi Bins, you may be asked to provide additional information such as your resume or CV, identification documents, academic records, employment history, references, and other background information relevant to your application.

Depending on the activity, some of the information may be required to complete the process, while other information is optional. If required information is not provided, you may be unable to participate in that activity. 

When you make a purchase through our Services (e.g., our website), your payment information is collected and processed directly by our third party payment processors. Yogi Bins does not receive or store full credit or debit card numbers. Our processors handle payment information in compliance with applicable payment industry standards (including PCI DSS).

2.2 Information Automatically Collected

Like most websites, we and our contracted third party service providers may automatically collect certain information when you visit, use, or interact with our Services. This may include:

  • Device and network identifiers: IP address (or proxy server), device, and application identifiers, operating system, system configuration, mobile carrier or Internet service provider, and related identifiers or features (some of which may qualify as personal information).

  • Usage data: Browsing history, pages and files viewed, searches conducted, date and time stamps, frequency of visits, browser type, plug-ins, integrations and other activity information relating to your use of the Services.

  • Location data: Real-time information about the location of your device, collected through our websites or applications when enabled. You may control collection and use of location information through your device or browser privacy settings; however, disabling location features may limit functionality of certain Services.

  • Preferences and settings: Language and advertising preferences.

  • Referral information: The website, application, or advertisement that referred you to our Services.

  • Social media interactions: Profile information if you access or engage with our Services through a social media platform.

This type of information is commonly collected online, and it may include personal information or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It is used to help us maintain and improve the functionality, security, and overall user experience of our Services, as well as for other purposes described in this Privacy Policy.

2.3  Information We May Receive About You

We may also obtain information about you from third party sources, including commercial providers of personal information and publicly available information. For example, we may supplement your contact information with address information provided by the U.S. Postal Service to qualify your information and prevent errors in our database. This helps us maintain accurate records, expand and analyze our database, identify new customers, prevent abuse, authenticate users, and deliver more relevant and/or customized advertising. For example, we may collect personal information about you from:

  • Our other customers, including when they send you a YOGI BINS product.

  • Our third party service providers who operate or support our online storefront and payment processing. For example, our website storefront is hosted on the Shopify platform (provided by Shopify Inc. (“Shopify”)), and we use third party payment processors to facilitate credit and debit card transaction. These providers may share with us transaction details necessary to complete your order (such as payment confirmation, billing/shipping information, or partial card details), but we do not receive or store your full payment card number.   • Social media providers (such as Instagram, Facebook, TikTok, and YouTube), including if you interact with us through a social media service, tag us or log in using social media credentials. For more information about the privacy practices of such social media providers, please review the specific privacy policies and settings of the platforms and networks that you use.

  • Analytics companies, and marketing or advertising providers, and other parties that provide us with information so we can better understand you and provide you with information and offers that may be of interest to you.

  • Joint marketing and business partners, when you consent to sharing your personal information with us;

  • Fraud prevention providers.

  • Other businesses in connection with any merger, acquisition, dissolution, or like transaction.

Some of this information may be in a form that does not, on its own, permit direct association with any specific individual or household. We may collect, use, transfer, and disclose non-personal information for any purpose. We also may combine this information with personal information provided by you; however, if we do combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined. 

2.4  Cookies and Other Tracking Technologies

We also use cookies and other common information-gathering technologies, such as tools for collecting usage data, web beacons, tags, pixels, and JavaScript, to automatically collect information that may contain personal information as you navigate our Services or interact with emails or other communications we have sent you. Whether used alone or in conjunction with each other, these technologies help us recognize you, understand and save your preferences for future visits and compile aggregate data about site traffic, site interaction so that we can offer better site experiences and services in the future. We treat information collected by cookies and other technologies as non-personal information; however, as noted above, to the extent that IP addresses or similar identifiers are considered personal information by applicable local law, we will treat these identifiers as personal information. 

Cookies are small files that a site or its service provider places on your computer or mobile or handheld device (such as smartphones or tablets) through your web browser (if you allow) when you visit certain pages on the internet or use certain mobile applications. Cookies are typically stored in your browser. In some cases, cookies may remain on your device after you close your browser or turn off your device. Cookies allow us to track and analyze site traffic, infer browsing preferences, and improve and customize your access and browsing experience. Most cookies won’t collect information like a name and email address that directly identifies you as a person and will instead be used in efforts such as collecting more general information such as how many visitors arrive at and use a website. Cookies may, however, be used to create a profile of a visitor’s activities on the internet, and they can contain unique identifiers or any form of personal information. Our goals in these cases are to make your experience with our Services more convenient and personal, to identify repeat visitors to our websites, and identify trends regarding how visitors find and navigate our websites.

Cookies may also be used for market research or to display advertising that is not directed to a particular individual. We may use our own technology or third-party technology to track and analyze usage information for the purposes of providing enhanced interactions and more relevant communications, and to measure and improve the performance of our advertisements and marketing campaigns. 

For example, we use Google Analytics (provided by Google Inc.) and Microsoft Clarity (provided by Microsoft Corporation) to understand how visitors interact with our websites and other digital platforms. Google Analytics uses cookies to help us analyze how our website is used, including the number of visitors, referring websites, and pages visited. We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our Services through behavioral metrics, heatmaps, and session replay to improve and market our products and Services. Website usage data is captured using first- and third-party cookies and other tracking technologies to determine the popularity of products and online activity. Additionally, we use this information for website and digital platform optimization, fraud prevention and security purposes, and advertising. We may may also use Hubspot to assess analytics of our website and other marketing efforts by using both usage data and cookies. Shopify provides information on tracking pixels that may be used with our Services at https://www.shopify.com/legal/cookies#merchant-storefronts

In addition, we may use server-side event tracking and attribution tools, such as Elevar and/or Triple Whale, to collect, process, and analyze event-level data from our website or e-commerce platform. These tools help us measure user interactions, improve conversion tracking accuracy, and understand the performance of our advertising and marketing activities across different platforms. Such tools operate similarly to analytics technologies by transmitting anonymized or pseudonymized event data that allows us to better optimize user experience and marketing effectiveness. The third party services and/or technologies we use to help us collect information are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

We use both session-based and persistent cookies on our website. Session-based cookies exist only during a single session and disappear from your device when you close your browser or turn off the device. Persistent cookies remain on your device after you close your browser or turn your device off. Additional categories of cookies may include required cookies, functionality cookies, performance cookies, and targeting cookies, described as follows:

  • Required cookies. Required cookies are necessary for basic website functionality, with some examples including session cookies needed to transmit the website and any authentication cookies. Because required cookies are essential to operate the website, there may not be an option to opt-out of these cookies.

  • Functional cookies. These cookies enhance functions, performance, and services on the website. Some examples include cookies that allow our website to remember the choices you make and your account preferences, and to provide enhanced, more personal features. For example, these cookies will remember your name and other details so you don’t have to re-enter them when completing a form. You can choose to opt out of functional cookies.

  • Performance cookies. These are analytics and research cookies that allow us to collect information about how visitors use our website, for instance which pages visitors go to most often, and if they get error messages from web pages. This helps us improve the way the website works and allows us to test different ideas on the site. You can choose to opt out of performance cookies.

  • Targeting cookies. These cookies record your visit to the website, the pages you have visited and the links you have followed. We may use this information to make the website and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose. You can choose to opt out of targeting cookies.

First party cookies are cookies set by us on our websites, and they can only be ready by our websites. Third party cookies are not set by us on our websites, but by a different organization. For example, advertisers and other third parties may use their own cookies when you click on an advertisement or link on our websites, or we might engage a third party analytics company that will set their own cookies to perform this service on our websites.

We use different categories of both session and persistent cookies on our websites, which can either be first- or third-party cookies. The various cookies used by our websites have different storage periods, at the end of which your information will no longer be stored. For example, session cookies will be deleted once you close your browser, while persistent cookies implemented on our websites will be kept on your device for a period of time.

Most browsers support cookies, but users can set their browsers to decline cookies and can delete them whenever they like. The Help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Please keep in mind that without cookies, you may not have access to certain features of our website, including access to certain personalized content.

Further, your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no industry consensus as to what site an app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals. 

We also may use clear GIFs, web beacons and pixels on our websites and in email communications. For example, we may place a pixel in marketing emails that enable us to send email messages in a format customers can read, and they tell us whether mail has been opened and/or if you click on a link in the email. We use these technologies to operate and improve our website and marketing emails. 

2.5  Sensitive Personal Information

Yogi Bins does not generally collect or process “sensitive personal information” (as defined under U.S. state privacy laws) from typical consumers through our Services. This includes information such as social security numbers, government-issued identifiers, information related to racial or ethnic origin, political opinions, religious or philosophical beliefs, health data, biometric or genetic data, criminal background, or trade union membership.

  • Geolocation: Yogi Bins does not collect precise geolocation information through our websites or online services. However, certain third-party service providers may process location data to provide localized features (for example, identifying nearby stores or events).

  • Legal Requirements: In limited cases, Yogi Bins may collect sensitive personal information as required by law, such as requesting a completed IRS Form 1099 from prize winners for sweepstakes or giveaways of Yogi Bins products above a certain value.

  • Investigations: Where legally authorized, we may collect sensitive personal information as necessary to investigate suspected unlawful conduct (e.g., fraud or counterfeiting).

Unless we expressly request it for one of the purposes described above, we ask that you do not send or disclose sensitive personal information to us through our Services or otherwise.

Yogi Bins does not “sell” or “share” sensitive personal information under the CCPA or other applicable U.S. privacy laws. We do not use sensitive personal information to infer characteristics about you, and we only process such information for the limited purposes described above or as otherwise permitted by law.

3.  Use of Personal Information

We and our service providers, contractors, and third parties use your personal information for the following purposes:

  • Providing, operating, and maintaining our Services.

  • Registering and maintaining your Yogi Bins account and communicating with you about your account and activities on or in connection with the Services.

  • Processing and fulfilling orders, exchanges, and returns that you have ordered or requested, and communicating with you about such orders, exchanges, and returns.

  • Enabling and improving customer service and support, including addressing and/or responding to your questions, suggestions, compliments, concerns, or complaints, and monitoring customer calls and chats for quality or training. 

  • Sending you administrative messages about our Services, including changes to terms, conditions, or policies, and recall or safety information.

  • Administering sweepstakes, contests, fundraising efforts, and special discounts; delivering promotional items or benefits; providing marketing communications and advertising we believe may be of interest to you; and sharing reviews, testimonials, or other user-generated content. 

  • Learning about customer trends and interests; tailoring content and product recommendations; and creating inference data by combining the information we collect about you from different sources (e.g., inferring your approximate location from your IP address or your product preferences from browsing activity).

  • Protecting our company, assets, users, and Services from fraudulent, harmful, or illegal activity.

  • Complying with applicable laws, regulations, legal processes, and governmental requests.

  • Initiating, operating, managing, and maintaining our business relationships.

  • In the furtherance of our legitimate business interests, such as licensing, selling, and promoting products, expanding brand outreach, data analysis, audits, researching and developing new products and services, identifying usage trends, and enhancing and improving our Services (including without limitation our websites).

  • Any other purpose disclosed to you at the time of collection or with your consent, where required.

Note: If at any time you would like to unsubscribe from receiving future emails or text communications, we include detailed unsubscribe instructions at the bottom of each email or text and you may also opt-out by utilizing the information in the “Contacting Us” section below. 

We only collect and process your personal information to the extent necessary to fulfill these purposes and where we can rely on a legal basis for such processing. Where required, we will ask you for your prior consent to processing. 

We may also aggregate and/or anonymize personal information so that it will no longer be considered personal information. We do so to generate other data for our use, which we may use and disclose for any purpose, as it no longer reasonably identifies you or any other individual or household.

4. How We Protect Your Information and Handle Data Retention

4.1 Security

Yogi Bins takes the security of your personal information seriously. We implement a variety of security measures to help protect your personal information from unauthorized access, use or disclosure and secure the personal information you provide on computer servers in a controlled, secure environment. We seek to use various physical, technical, and organizational measures to protect personal information within our organization. However, while we strive to protect the personal information submitted to us and take into account the sensitivity of the personal information we collect, process and store, unfortunately no method of transmission over the Internet or method of electronic storage is 100% secure and we cannot guarantee its absolute security. 

If you have questions about security on our Services or have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contacting Us” section below.

4.2 Data Retention

We plan to retain your personal information only for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law. When we determine that we have no ongoing legitimate business need nor lawful legal ground to process your personal information, we will take steps to delete, anonymize, or aggregate it or, if that is not appropriate (e.g., because your personal information has been stored in backup archives maintained in the ordinary course of business), then we will store your personal information until deletion is possible.

We determine the appropriate retention period primarily on the basis of the amount, nature, and sensitivity of the personal information being processed, the length of time we have an ongoing relationship with you and provide the Services to you, whether we can achieve the purposes of the processing through other means, whether there is a legal obligation to which we are subject (e.g., certain laws that require us to keep records of your transactions for a certain period of time before we can delete them), and whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations and/or litigation or regulatory investigations). 

After expiry of the applicable retention periods, your personal information will be deleted. If there is any personal information that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any further use of such personal information.

We do not sell, exchange, or trade your personal information for money. However, certain disclosures described below may be considered a “sale” or “sharing” under U.S. state privacy laws (including the CCPA), even when no money changes hands.

We contractually require service providers and contractors to protect personal information and restrict its use to the services performed for Yogi Bins.

5.3  Trusted Third Parties and Authorities

5.4 De-identified and Aggregate Data

We may share anonymous, de-identified, or aggregate data with service providers or publicly for purposes such as improving our Services, conducting analytics, or demonstrating trends in product usage. Such information will not identify you personally. 

5.5  Your Opt-Out Rights

Residents of certain states, including California, may have the right to opt out of the “sale” or “sharing” of personal information or targeted advertising. You may exercise this right as described in the “Your Rights” section or by managing cookie preferences in your browser.

If your browser sends a legally recognized opt-out signal, such as the Global Privacy Control (GPC), we will honor that signal as a request to opt out of sales, sharing, and targeted advertising for that browser. You may override this preference at any time using our cookie management tool.

6. Use of Services by Minors

Our Services are not directed to, and we do not knowingly collect or request personal information from, individuals under the age of 18. If we become aware that we have collected personal information from a minor under 18 years of age, we will promptly delete it.

However, we may offer different prices, rates, or quality levels of goods or services if those differences are reasonably related to the value of your personal information, as permitted by applicable law.

We may offer financial incentives in exchange for the collection, retention, or use of your personal information, such as discounts, coupons, loyalty rewards, or other promotional offers. We may need to verify your identity when processing your request. To do so, we may request that you provide information such as your full name, the email address associated with your account or order, and other details we already have on file. This information will be used only to verify your identity and will be deleted once the verification process is complete.

We will respond to your request within forty-five (45) days or as otherwise required by law. If we need more time, we will notify you of the reason and extension period. Please note that certain requests may be denied or limited as permitted by law.

You may also access, correct, or delete certain personal information and update your privacy preferences directly at any time by logging into your account through the Portal and clicking on “[Insert Hyperlink/e.g., My Account].” For security purposes, some information can only be changed by contacting us as described above.

Refund policy

At Yogi Bins, the customer is our top priority. We will do everything in our power to make things right if you have an issue. We have a 30-day return policy, which means you have 30 days after receiving your item to request a return. 

To be eligible for a return, your item must be in the same condition that you received it: unused and in its original packaging.

Once your return is requested, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Unfortunately, we cannot accept returns on sale items or gift cards.

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 7 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

All orders will ship from our warehouse within 2 business days (Monday - Friday) of the order being received. Once the order ships, the transit time is between 2-6 days depending on the carrier and your location.

We are excited you are on Team YOGI and helping us become part of the solution to the pollution. Yogi Bins is available for standard shipping on all orders shipped in the contiguous United States only. Shipments to Alaska or Hawaii are available at an extra charge. Please contact shipping@yogibins.com for questions about these orders. We do not ship to US territories outside of the contiguous United States (*U.S. Territories include American Samoa, Guam, Marshall Islands, Micronesia, North Mariana Islands, Palau, Puerto Rico, and the U.S. Virgin Islands). Other items such as accessories and add-ons will incur a shipping charge dependent on weight if purchased on their own.

All services are provided by UPS, FedEx and other US shipping companies. Shipping delays due to weather, natural disasters, or other uncontrollable events cannot be foreseen and may increase delivery timeframe. Shipping services and rates are subject to change without prior notice.
